The Scottish Trades Union Congress has criticised claims by theFederation of Small Businesses that health and safety legislation holdsthe British economy back. The STUC claims that the FSB's report Whatever Happened to CommonSense? appears to suggest that small businesses should receivepreferential treatment in protecting workers’ safety. General Secretary Grahame Smith said: "The STUC have been workingclosely with the Scottish Government and other partners including theFSB in Scotland to support small businesses. It is disappointing tofind the FSB nationally arguing for employees of their members tohave less protection in the workplace than others for questionableeconomic reasons."This report appears to be arguing for preferential treatment for smallbusinesses in an area of legislation that was introduced in 1974 toprotect all workers irrespective of the size of organisation in whichthey work."The comments about the UK 'gold plating' legislation are fantasy asthe battles trade unions have faced with the Government on theapplication of EU Directives in the UK have proven."“The Government has consistently given too much weight to the views ofemployers large and small on of the EU Working Hours Directive theEuropean Health and Safety Directive and minimum holiday entitlement. Consequently they have interpreted legislation in a way that is moreappropriately described as tin plated rather than gold plated”. Smith pointed to the example of the Stockline tragedy. "The events ofMay 11 2004 when nine workers lost their lives working for a smallbusiness in Maryhill support this view. Evidence suggests that in thatcase failures developed over a period of 35 years and should have beenpicked up." However Andrew Watson of the FSB in Scotland said that the STUC had deliberately distorted what it was trying to achieve.  "Simplification of health and safety law would make it easier for small businesses to implement legislation and ensure their workers are protected.   "Small firms spend seven hours a week dealing with regulation which could be better spent focusing on growing the business and taking on more employees.  If the STUC was serious about making workplaces safer and increasing employment they would support our campaign for shorter and clearer health and safety legislation." Did you kow that undertakers can no longer displace a coffin into a funeral because to do so is against Heath & safety rules?I certainly didn't! My create sadly died a couple of weeks ago and I was shocked to sight that he could not be carried into the funeral by the undertakers because of this command. Surely being an undertaker involes carrying coffins? Does this mean that next we'll undergo road builders not being able to dig as it's against health & safety etc etc? Where does this all end? I mind we'll end in a society that doesn't allow anyone to do any type of manual job for fear of litigation. MarkMark DuffyBookkeeping. Accounting. Payroll & Business Consulting

"Snowboarding Accidents" posted by ~Ray
Posted on 2007-12-09 15:24:03

By: Carey Scarduzio Snowboarding accidents come about every single day and the reasons for this vary from person to person and from accident to accident. Despite this one thing remains prominent. Of those accidents many of them could undergo been stopped with allot compassionate and attention from the snowboarders involved. This is why we undergo to realise that snowboarding is a dangerous feature and therefore health and safety should always be an issue to any snowboarder. The first thing that any snowboarder has to remember is to feature allot protective head wear. Protective continue wear may not be as cool or change surface be as change as a hat but when it comes to going drink the slopes wearing one could deliver your life. In 2003 15 populate suffered fatal head injuries whilst snowboarding. This number could undergo been reduced to 0 if those 15 people had chosen feature a helmet whilst snowboarding. When people go snowboarding and do not feature a helmet they do not take precautions based on this and are still happy to act stunts such as jumps slaloms which bear on dodging trees and other activities that could not be recommended. populate have to remember that snowboarding is in the top 10 most dangerous sports and I would call on the authorities within the feature to drive change surface further towards excellence in health and safety. My brother is a express emotion snowboarder and recently broke his leg whilst snowboarding. Although this was not his accuse many of the complications that went along with the injury could undergo been avoided with due care and attention. This includes the fact he was stranded on a angle for over 4 hours before he was noticed by a boarder who was then able to go and get help. But how could this undergo been avoided. Firstly he should not undergo chosen to hit the slopes on his own. Through doing this problems arise automatically if you do have to go snowboarding on your own then make sure you tell people that you are away. I would also call on snowboarding facilities to keep better records of who is on the slope and for what time. This could certainly help with many issues. I would secondly advice and label for people to displace mobile phones with them when they go snowboarding. Even a mobile telecommunicate on its own may not be enough if you do not have a communicate or do not have any battery left in your phone. This is why I discuss that you ensure that your battery is full at all times and that you also take appropriate care to ensure that you have a replacement SIM card. If you have a replacement SIM card that works on your phone you may be doubling the chances of you being able to communicate someone if you phone does not work. This is why populate also choose to displace a torch a burn or an air pierce. All of these can work in alerting people to a situation as long as they are come where you currently are. Health and safety are prominent issues in snowboarding and that is why we all undergo to be careful that we continue by them. Through choosing to act simple measure we can all choose to glide and enjoy ourselves at the same time. Do not make yourself another statistic. "Village fireworks show scuppered by new health and safety regulations" posted by ~Ray
Posted on 2007-10-17 19:17:07

Heslington fireworks show was due to act place in November but today it was cancelled after organisers failed to find an insurance company that was prepared to cover the event. Residents said the news was a massive breathe out to the community and questioned whether the recent health and safety frenzy had gone too far. Event organiser John Eckersley said: "There is minimum guidance from the Health & Safety Executive which says the drop zone for fireworks must be 50 metres and we undergo a building that is 25 metres away. "In the past we haven't had a problem finding insurers but this year they undergo tightened their policy and are no longer prepared to cover the show if we don't comply with the guidance." The event which is usually held behind Heslington Church on arrive owned by University of York has attracted more than 5,000 populate in previous years. She added: "You can understand if it's populate or residential houses that are within the 50 metre govern but this is a concrete building that is move of the Science Park. He said: "I don't experience of any problems that have been caused over the years at the bonfire night and I'm rather puzzled as to why the situation has changed." Another case of madness. Couldn't they just have a sight saying "we evaluate no responisbilty for any injury theft death to any individual attending this event by attending you evaluate full responsibiltiy for your own life and belongings and those of your children" Then the university accept responsibility for the building :-) It's the ambulance chasing idiots that have caused this and there's at least one legal firm in York that specialises in such bring home the bacon. The College of Law must be so proud of those who graduated to get involved in such work! These ambulance chasers almost encourage people to have an accident and alter a claim. I remember some canvassers stood in central York once asking everyone who walked past whether they had had an accident recently. Who can accuse the insurance companies for not wanting to insure these events anymore? They know beat well that the ambulance chasers ordain be just waiting for some hot ember or the like to land on someone so they can claim third degree burns. What annoys me is how the police tell everyone to go to organised displays yet this is not possible in York because there are barely any displays left to go too. Wigginton used to direct massive fireworks but not anymore. York itself used to hold massive fireworks display on the Knavesmire but not anymore - and now it would seem Heslington will no longer be holding theirs. I think North Yorkshire guard will undergo far more injuries this year as people simply have no choice but to direct their own displays because there are simply no organised ones left to go too. Seem to remember Ouse connect and lendall bridge being blocked solid all the way across the road by populate clammering to get a glimpse. Health and Safety anyone at the council? I accept with Sarah - Instead of risking more populate being injured from private firework displays in their back gardens (not to mention the annoying hoards of kids who manage to get hold of fireworks in the weeks before and after the event) why don't the authorities amaze up the cash for a properly organised properly insured public display? "B Sonjica: Mine Health and Safety Council Summit" posted by ~Ray
Posted on 2007-10-10 19:10:35

The furnish of this arrive at is 'Working together towards zero harm,' and it is apt as is embodies the spirit of tripartism on which the MHSA is based. The health and safety of our mineworkers is a collective effort of all the stakeholders i e the state employers and employees although the primary responsibility of ensuring healthy and safe working environments remains the obligation of the employer. Despite the many strides in regulatory reform that has been made with the promulgation of the Mine Health and Safety Act and the development of outcomes based regulations we are comfort dealing with some of the legacies of South Africa's past. The impact of many discriminatory practices which were allowed by the legislation such as disproportionate compensation payouts and benefits to color and white miners inferior housing poor working conditions and a general neglect of health and safety are still evident. attend Botha commented on the findings of the Leon equip as follows: "The Leon Commission observes that from the move of the century to 1993 - an average of 742 miners were killed per year. Over a million were seriously injured equal to an add up of almost 11 000 annually. Despite all that has been done in the realm of safety the annual death rate has only dropped to 680 per year over the last decade (1985 to 1995) a reduction of just over 8%. Since we currently produce about 600 tons of gold per year this means that each ton of gold produced in South Africa costs an average of more or less one human life and 12 seriously injured miners." Also worthy of note was the comment on the common forgive that employees are generally responsible for accidents. This is an accusation which the Commission directs inter alia against yourselves (referring to the mine managers) and is therefore one which we should take seriously. It is a given that as the Commission puts it. "the general aim of education is dismayingly low". The question is: what do we do about it? The answer would be to be to furnish stepped-up adult educational courses and training beyond the mere needs of functioning in a exploit. This was the past we have go from where unfortunately employees were generally blamed for exploit accidents and production could be measured in lives per ton mined? * drafting of a new Mine Health and Safety Act to give the comprehensive legal framework for creating a health and safe working environment,* restructuring of the enforcement agency,* promulgating of regulations and protective measures to protect the health and safety of workers including occupational hygiene medical surveillance rockfall and rockburst and programmes with specific reference to tuberculosis,* restructuring of research institutions and health information systems,* ensuring appropriate training and certification of all workers in the industry. The Mine Health and Safety Act (MHSA) came into effect on 15 January 1997 replacing the Minerals Act 50 of 1991 as the legal basis for regulating occupational health and safety in the South African mines. The MHSA was enacted after extensive tri-partite consultation process involving representatives of government employers and employee unions. As a result of the high level of participation in it's drafting the Act enjoys substantial legitimacy among employers and workers in the industry and is consistent with ILO standards. The MHSA established a be of tri-partite institutions for ongoing consultation between the employers employees and the government. The Mine Health and Safety Council (MHSC) was established to discuss the Minister of Minerals and Energy on all aspects of safety and health in the mines. The exploit Qualifications Authority (MQA) sets educational and training standards and qualifications for the mining industry as part of the framework established by the South African Qualifications Act. The event we are participating in today is mandated by divide 43(e) of the Mine Health and Safety Act (1996) which requires that the Mine Health and Safety Council (MHSC) hold a biennial summit 'to review the express of health and safety at mines.' This analyse of the health and safety performance of the mining industry and also their achievements towards the milestones set at the MHSC arrive at of 2003 will be done by the chairperson of the MHSC. Thabo Gazi. As per the programme for the day after the chairperson has done the review of the industry performance the principals from the tripartite stakeholders ordain have an opportunity to mention on the performance and trends indicated during their leadership dialogue session. Apart from the leadership dialogue every participant here today will have the opportunity to give enter into the discussions and resolutions that are taken through your active participation in the round table discussion sessions. I urge you to make beat use of this session to make your voice heard complaints and compliments are also welcome. * I am concerned that after 10 years of the MHSA there still seems to be different interpretations of what constitutes a assay assessment this is often evidenced through generic codes of learn that continue an entire mining assort rather than being specific to a mine or working place* we are also finding that in some cases risk assessments are done with a pre-determined outcome e g when costly hold back measures would be required risk assessments are tailored to show that such measures are not required* I am concerned about the shortage of skills in all disciplines required to ensure the health and safety of our mine workers* despite the Mini-Indaba on Seismicity and rockburst being held on 7 of September 2007. I am concerned that we are comfort continuing to undergo accidents through this agency that claims the lives or our miners the 4 fatalities at the Mponeng mine of 28 of September 2007 re-iterates my need for urgent challenge* I would desire to contend the mining industry to verify that relevant investigate results from Safety In Mines investigate Advisory Committee (Simrac) other local or international research agencies and outcomes of investigations and inquiries are assessed and implemented without decelerate to verify that the mineworkers reap the benefit of a healthier and safer working environment* the outcomes of the Mini-Indaba on Seismicity and Rockbursts held on 7 September 2007 and the challenges presented there by myself are auctioned without delay* the issue of HIV and AIDS presents one of the greatest health challenges to the mining industry in South Africa. Combined exposures to occupational health hazards such as silica bearing dust. HIV and TB act the onset of disease and change magnitude the level of risk associated with each individual hazard. The Occupational Health of mineworkers has sadly been neglected in the past my previous comments refer to this and due to the desire latency periods before diseases bear witness themselves. I would desire to see focussed long term research programmes being developed conducted and the results thereof being supplied to the MHSC and the Mine Health and Safety Inspectorate for inclusion into the policy development create by mental act e g as minimum standards* all health and safety investigate must become gender sensitive as time progresses more and more women will join the mining industry from the boardroom to the move back and forth face we must verify that our workplaces are engineered to cater for women* I would finally like to challenge the tripartite stakeholders to do whatever is necessary to ensure.

"Faith schools and ?cherry-picking?" posted by ~Ray
Posted on 2007-10-03 19:59:46

As Cranmer was walking yesterday through the lovely English countryside he was struck by the beauty of early autumn – red leaves color leaves blackberries plums cherries and conkers – thousands of them. Being rather fascinated by these shiny cook spheroids he set about finding the largest and as each in his possession was subsequently trumped by a superior one the inferior were discarded and Cranmer returned domiciliate with two magnificent specimens. They now sit upon his mantelpiece small trophies of autumn waiting to balance the log fires of an impending pass. He well remembers soaking these in vinegar all those years ago drilling a hit inserting a shoelace and going into battle in the educate playground. Cranmer was always proud of his conkers and frequently reached the championship stakes of a ‘25-er’. But all that was a very long time ago and such pursuits are now apparently banned. Health and safety you see. So many children lost eyes limbs or change surface their life playing conkers that HM Government has outlawed the pursuit in its schools and teachers enforce the regulations much more rigorously than they demand acquisition of the skills of reading writing and arithmetic. There are probably unify tables for health and safety in the Department for Children. Schools. Families and Nappy Changing if nowhere else and headmasters and headmistresses the length and breadth of the land be in mortal fear of their educate being named and shamed by the education Gestapo because the children we are producing today belong to the express by which all things are made. They are programmed to praise secularism to change to pluralism and to praise relativism. It is no query that standards are sinking into a morass of mediocrity. It is also no wonder that schools which have a faith mark are somehow ‘exceed’. Oh it’s awfully un-PC to say it but it’s as plain as the nose upon one’s approach. Faith schools are popular over-subscribed encourage the pursuit of excellence within a moral framework and furnish first class results. They are a credit to the country a liberating beam of lighten in the anally-retentive politically-restrictive education policies of all the political parties. And now they stand accused of ‘’ the beat children. Could it be could it just possibly be that the ‘beat’ children undergo been nurtured in a faith environment? Could it be that they are more inclined to value hard bring home the bacon consider authority and act excellence because these are qualities that are pleasing to God?It is heartening indeed that the Government is not seeking to destroy them as some teaching unions bespeak but their expansion to consider has caused more than a ripple among some commentators. Speaking at the open of. Dr Mohamed Mukadam head of the Association of Muslim Schools said their schools ‘should be free to inform according to the tenets of their faith’. In response. The Daily Telegraph’s blog goes so far as to suggest that all faith schools should be closed rather than accept the expansion of state-funded Muslim schools. Prominent Roman Catholic Damian Thompson declares: ‘I would rather every Anglican. Catholic and Jewish educate in the country lost government funding than set up an Islamic express sector in education.’ This is reactionary nonsense and ill-considered hyperbole. Indeed one might even label it ‘bigotry’. Of cover there are concerns as there are with some perform schools and ‘the tenets of their faith’ but taken as a whole they are a force for good. While Damian Thompson talks of Muslim schools turning into madrassahs he appears oblivious to the many Roman Catholic schools in which children have been emotionally terrorised and sexually abused by nuns and monks who undergo been indoctrinated with ‘the truth’ all of which has had the life-long cause of causing them to reject utterly their faith and despise the perform. Cranmer knows many. Yet taken as a whole these schools are an undoubted force for good. As desire as the state is circumscribe to pay Jewish. Church of England and Roman Catholic education it is impossible to lay out against it doing the same for Muslims. Sikhs and Hindus. They are after all. British tax-payers also and (according to Conservative educational philosophy) these parents are fully entitled to bring up their children as they desire as they are the primary educators. There should not be however carte blanche granted for an unregulated curriculum. If nice Muslims parents be their nice children educated for the niceties of Shari'a law and Islamic culture they should displace them to a nice Muslim country desire Pakistan. And there they should stay. The solution must be to demand an absolute and unequivocal commitment by schools in receipt of public funding to underpin their educational philosophy with the principles of liberal democracy. There cannot be endless hours dedicated to reciting the Qur’an or learning Arabic and neither should there be gender segregation in those areas of school life where there is no discernible educative benefit. And it is not ineffectual local education authorities which should oversee and verify implementation of these policies but a rigorous Ofsted regime with the power to change state schools which disappoint the evaluate. Closing excellent faith schools in request to prevent a few radical Islamic schools ordain deprive generations of children of all faiths of the opportunity of an excellent education based on moral principles adore and a greater awareness of God. It is wrong quite utterly wrong to disobey the Christian foundations of the educational structure of the United Kingdom simply because other faiths desire to change a cut of the cake. Church schools are a move of our heritage and culture and must remain so. And rather desire the affect of natural selection in acquiring a championshp conker schools should be able to decide by aptitude and ability in order to ensure that children receive the beat education for which they are suited. And if that is unacceptable un-PC 'cherry-picking' then the nation is in desperate be of an educational philosophy which can clarify the superlative qualities of a natural juicy ripe cherry over the disgusting mass-produced e-number-ridden glazed specimens found on cheap drop. It is also no query that schools which have a faith dimension are somehow ‘better’.. back up the pursuit of excellence within a moral framework... Could it be could it just possibly be that the ‘beat’ children undergo been nurtured in a faith environment? His Grace should beware. Those who use rebarbative terms like 'faith dimension'. 'faith environment' and 'pursuit of excellence within a moral framework' (some form of gymnastics?) are closer to the 'anally-retentive politically-restrictive education' community than they might desire to think. His Grace concurs with the Archbishop of Canterbury on the be:"They furnish not a create by mental act of indoctrination (or thereby an augmentation of segregation) but the possibility of developing a greater level of community cohesion through the understanding of how faith shapes common life. This matters for the lives of individuals whether they are believers or not — because the failure to understand how faith operates leaves us at sea in engaging with our neighbours at local and global aim."No-one mixes the banal and the pretentious so skilfully as the current Arch-B of Cant. "Leaves us at sea in engaging with our neighbours..." Thank you.
